Heard Mr. S.K. Goswami, learned counsel for the petitioners as well as Mr. S.C. Keyal, learned counsel for the respondents.

Upon instructions, the learned counsel for the petitioners has submitted that though belatedly the order of the Court has been complied with and the first installment of pension for two months has been released.

Although the delay in compliance of the order of this Court is not appreciated, nonetheless though belatedly, the order of this Court has been complied with, the Court is inclined to close this contempt petition.

It has also been submitted by the learned counsel for the petitioner that the petitioner no.2 namely, Dr. Satya Bhusan Paul and petitioner no.7, namely, Dr. Nikunja Behari Biswas had expired during the pendency of this contempt petition.

In this regard, the learned counsel for the respondents has submitted that notwithstanding the death of the petitioner nos.2 and 7, the legal representatives of the deceased would be entitled to receive the financial benefits, if the proof of death is produced before the authorities along with an appropriate application. The learned counsel for the petitioners shall take note of the said submission.

Accordingly this matter stands closed on compliance.
