Heard Mr. S. N. Krishnatraya, learned counsel for the petitioner and Mr. M. Dutta, learned Standing Counsel for the respondent Bank of Baroda.
By the communication dated 27.01.2022, the respondent bank informed the petitioner about the seizure of its stock kept at Mukund Complex (Behind Rhino Complex), Paschim Boragaon, Guwahati Warehouse giving notice of seven days’ time to clear the total outstanding amount and unpaid interest along with costs.
Being aggrieved with the same, the petitioner has preferred this writ petition.
During the deliberation of the matter, Mr. Dutta, learned Standing Counsel for the respondent bank has placed a communication dated 03.03.2022 issued by the respondent bank to the petitioner, sent by registered post which goes to show that the respondent bank has withdrawn its letter dated 27.01.2022 which is under challenge in the present proceeding.
In view of the above, this writ petition being infructuous stands dismissed.
Copy of the communication dated 03.03.2022 of the respondent bank be kept as a part of the record.
