Heard Mr. N. Uddin, learned counsel for the petitioner. Also heard Mr. Bankim Sarma, learned Additional Public Prosecutor, Assam for the Respondent State.

The offence under Section 67(A) of the Information and Technology Act, 2000 is bailable, being the first offence. So far the allegation of commission of offence under Section 354A of the IPC is concerned, it does not appear to this Court that any of the offences categorized at Serial No.(i), (ii) and (iii) of Section 354A of the IPC is found to have been committed by the present petitioner. However, this view is prima facie and subject to final conclusion of the investigation.

In view of the above, this Court is of the view that the petitioner is entitled to grant of the privilege of pre-arrest bail and, hence, granted.

The interim protection granted to the petitioner, vide order dated 22.03.2021, is made absolute by this order on the same terms and conditions.

The anticipatory bail application stands disposed of accordingly.
