This is an application made under Section 439 Cr.P.C. , seeking bail by the accused-petitioner, namely, Md. Abdul Karim @ Haque @ Hanu, in connection with Mukalmua Police Station Case No. 300 of 2021 , registered under Section 22(C) of the NDPS Act .

been tested positive for contraband. There are materials in the case diary also. The contraband involved in this case is of commercial quantity. That being so, the rigors of Section 37 (1)(b)(ii) of the NDPS Act applies in this case. Since there is no material placed before this Court to record its satisfaction as per the said provision of law, the prayer for bail of the petitioner is rejected . In terms of the above, this bail application stands disposed of. Return the case diary.
