Dilip Kumar Kalita Vs the State of Assam

This is an application, filed under Section 438 of the Cr.PC. seeking pre-arrest bail of the accused-petitioner, namely, Sri Dilip Kumar Kalita, who is apprehending arrest in connection with Garchuk PS Case No. 128/2019 under Sections 120B/420/468/403 IPC.

Heard Mr. B. Chakraborty, learned counsel for the accused-petitioner as well as Mr. N.J. Dutta, learned Additional Public Prosecutor, appearing for the State of Assam. Also perused the case diary produced today.

The petitioners were granted interim pre-arrest bail and he has already been interrogated by the Investigating Officer.

It is submitted by the learned counsel for the petitioner that other two co-accused have been granted pre-arrest bail and therefore, the petitioner also standing on the same footing deserves similar consideration.

Having considered the materials in the case diary, this court is of the view that custodial interrogation of the petitioner may not be necessary in the interest of investigation. Therefore, the order dated 29.05.2019 granting interim pre-arrest bail to the petitioner is hereby made absolute under the same terms and conditions.

This petition stands disposed of accordingly.
