This case is already fixed on 23.04.2026, but applicant has filed I.A. No. 354/2026 for early hearing and I.A No. 355/2026 seeking amendment in the SA.
As the matter is taken up for hearing so IA no. 354/2026 stands disposed of as allowed, the earlier date fixed 23.04.2026 stands cancelled.
The bank had put the property on auction vide auction notice dated 02.03.2026. According to the applicant, there is a order passed by publication made by Bikaner Development Authority directing the general public not to deal with the Patta listed in the notice which includes Patta at no. 8 of the present applicant.
Counsel for the bank submits that they were not aware of that notice. It is the public notice, Notice in REM applicable to all and there are specific directions by the Patta issuing authority not to deal with the said property, Bank is bound by it. Therefore auction stands quashed. Bank may approach Bikaner Development Authority for clarification for finding genuineness of their Patta.
