In this matter, counsel for the respondent FI submits that inadvertently notices could not be issued to one of the borrower. He seeks liberty of this Tribunal to issue corrigendum to the notice under Section 13(2) and submits that they will wait for 60 days after service of that notice to the person who was left out.
Notices be issued to the remaining borrower. No corrigendum to be issued as it is an amendment to the earlier notice.
Applicant is at liberty to approach the respondent FI for settlement. Expenses of the proceedings should not be debited to the applicant.
Accordingly, SA stands disposed of, all pending IAs also stands disposed off, if any.
File be consigned to record as per rules. Copy of order be uploaded on website.
