As per the averments in the apprication, the Appricant Bank states that defendant avaired personar roan of Rs.20,00,000 /- vide agreement dated 24.Lt.2e22 and agreed to repay om 60 installments with an EMI of Rs.42,74L/- p.m. After availing the loan facilities, the defendant failed to compry the terms of sanction, hence the appricant bank classified the account as NpA and recail notice was issued on 13.08.2025' Inspite of severar requests and demands, the defendants did not clear the outstanding. Hence this OA.

Defendant called absent and set exparte on 25.02.2025.

Ms. Adithya A.S, Manager of the Applicant Bank examined herself as AW.1 and exhibited relevant documents, which are marked as Ex.A.1 to A.7.

Heard the Ld. Counsel for the Applicant Bank.

The point that arise for consideration is whether the Applicant Bank is

entitled forthe claim made in the OA against the Defendant as prayed

for?

To substantiate the case of the Applicant Applicant Bank was examined and she

exhibited relevant documents as Ex.A1 to A.7. In view of the above,

I hold that the Applicant Bank has established their claim made in the

OA against the Defendant and hence the Applicant Bank is entifled to

¶32

recover the claim made in the OA with future interest and costs.

In the result, the present OA is allowed with costs, as under: The Defendant is riabre to pay to the Appricant Bank a totar sum of Rs.2O,58,O72.O4ps (Rupees Twenty Lakhs Fifty Eight Thousand Seventy two and paise four only) with further interest @ 1go/o p.a from 12.09.2025 till the date of realization.

9' The Appricant Bank is arso entired to proceed against the person and properties of defendant towards realization of the debt due.

The Applicant Bank is entitled to the costs of the OA.

11' The Appricant sha, fire a cost memo within two weeks from the date of receipt of order.
