M/s Sri Srinivasa Books General & Stationary represented by Applicant No'2 availed loan of Rs.27 lakhs from shriram city Union finance Ltd. in the year 2O18. But due to slump in the business, the Applicants could not pay some instalments. However, the Applicants have not availed any credit facility from the Respondent herein and the security interest created by the Applicants in favour of Shriram City Union Finance Ltd. is not registered under Section 26 of the SARFAESI Act,2OO2. the Respondent declared the loan account as NpA illegally. without issuing demand notice and possession notice to the Applicants, the Respondent initiated proceedings u/ s l4 of the SARFAESI Ac t, 2OO2 for taking physical possession ofthe schedule propert5r and so, the said proceedings are not legal and valid. The impugned possession notice was not published in two daily newspapers and as per the Award passed by the Arbitrator, the Applicants are not liable to the pay the amount as claimed in the demand notice.
