1' The Appricant Bank fired the present oA against Defendants for recovery of a total sum of Rs.l4,67,gS9/_ (Rupees Seventy Four Lakhs Sixty Seven Thousand Eight Hundred and Fifty Nine only) with future interest @ g.B5o/o p.a with monthly rests along with penal interest @ 20/o p.a additionar from date of firing of oA ti, the date of rearization and in defaurt for sare of mortgaged property as mentioned in the schedule to OA.

As per the averments in the application, the Applicant Bank states that defendant no,1 and 2 availed housing loan of Rs.66.00 lakhs on 15.05.2023 and executed demand promissory note, bearer letter, home loan agreement, RBLR agreement etc. The defendants mortgaged the schedule property in favour of Applicant bank and deposited the title deeds. After availing the loan facility, the defendants failed to comply the terms of sanction, hence the applicant bank classified the account as NpA on 2g.07.2024 andissued legal notice dated 26.09.2025. Inspite of several requests and demands, the defendants did not clear the outstanding. Hence this OA.

Sri P. Vinod, Chief Manager of the Applicant Bank examined himself as AW.1 and exhibited relevant documents, which are marked as

Heard the Ld. Counsel for the Applicant Bank,

The point that arise for consideration is whether the Applicant Bank is

entifled for the claim made in the OA against the Defendants as

prayed for?

7' Defendants remained exparte. To substantiate the case of the Applicant Bank, AW.1, official of the Applicant Bank was examined and he exhibited rerevant documents as Ex.A1 to A.17. In view of the above' I hord that the Appricant Bank has estabrished their craim macte in the oA against the Defendants and hence the Appricant Bank is enti'ed to recover the craim made in the oA with future interest and costs.

B. In the result, the present OA is allowed with costs, as under: The Defendants are joinry and severary riabre to pay to the Appricant Bank a total sum of Rs.74,6l,g59/_ (Rupees Seventy Four Lakhs Sixty Seven Thousand Eight Hundred and Fifty Nine only) with
