The Applicant Bank filed the^{presentOA against Defendants for}

a) A sum of Rs.6,14,58,673/- under term loan account with future interest @ 13.25olo p.a with monthly rests from date of filing of OA till the date of realization ;

b) A sum of Rs.5,64,35,601.52ps under OCC/ODBD account with future interest @ 12.15olo p.a with monthly rests from date of filing of OA till the date of realization ;

c) A sum of Rs.1,38,2t,057/- under GECL account with future interest @ 9.10o/o p.a with monthly rests from date of filing of OA till the date of realization ;

d) A sum of Rs.1,60,67,645/- under GECL 1.0 account with future interest @ 9.25olo p.a with monthly rests from date of filing of OA till the date of realization ;

As per the averments in the application, the Applicant Bank states that defendant no.1 is a Private limited company represented by its authorized directors and defendants no.2 to 9 availed term loan facility of Rs.819.74 lakhs, OCC/ODBD of Rs.470.00 lakhs, GECL of

Rs.172.00 I 1.0 facility of Rs.145.00 lakhs. Defendants equitable mortgage of OA schedule pro in favofi of nppli6aAi by depositing the originat title deeds and um of deposit of title deeds on o: oziLrSo, r#&+€fffron and 2o.02.2o2t respectivery. Subsequently' o.B expired and legal heir already added to

the proceedings. It is submitted by the Applicant bank that the Defendants availed the said loan facilities and failed to keep up the repayment schedule, as such the account was classified as NPA on 10.10.2023. Inspite of demands made by Applicant the defendants have not regularized the account, so the Applicant bank issued^legal notice dated 17.08.2024, but the defendants did not come^{forward to} repay the same. The total claim of Applicant against^{defendantsis of}

Rs.L4,77,82,9761- (Rupees Fourteen Crores Seventy^Seven Lakhs Eighty Two Thousand Nine Hundred Seventy Six only) with future interest @ 13.25%^p.a, @l2.L5o/o^{p.a, 9.10o/op.a and} @ 9.25o/o^p.a respectively with^{monthlyrests from date of filing of OA till} the date of realization. Hence the OA.

Though the counsel for Defendants¹ to^{4, 6lo 9 filed vakalathbut} failed to file Written statement. Hence the^{right of filing WS of} Defendants no.1 to 4,6, 7 and 9 was forfeited^{on 01.07.2025.} Defendant no.5 set exparte. Defendant^{no.8 died and her LR is on} record.

Mr. C.N. Swamy, Chief Manager/ AW.1 who was examined on behalf of the Applicant. Exhibits A.1 to A.55 are marked through AW.1. Defendants not filed written statement. So the evidence of AW.1 stood unrebutted by the defendants. In view of the above, I hold that the Applicant Bank has established their claim made in the OA against the Defendants and hence the Applicant Bank is entitled to recover the claim made in the OA with future interest and costs.
