The Applicant Bank filed the present OA against Defendants for recovery of a total sum of Rs.2,13,83,210.00 Ps. (Rupees Two Crores Thirteen Lakhs Eighty Three Thousand Two Hundred Ten Only) with future rate of interest @16.00% p.a with monthly rests 'from 22.04.2026 till the date of realization and in default for sale of Hypothecated Movables and Mortgaged Property as mentioned in the Schedule of Property Ito lllto OA.

As per the averments in the application, the Applicant Bank states that Defendant no. 1 is a^private limited company availed cash credit loan facility of Rs.248.44 Lacs with interest and executed Agreement of Loan cum Hypothecation dated 28.04.2014 in favor of the Applicant Bank. The Defendants no. 2 to 5 stood as a Guarantor in the loan facilities availed by the Defendant no.1 and executed Guarantee Agreement dated 28.04.2014 in favor of the Applicant Bank. 08.10.2014 in favor of the Applicant Bank.^{The Defendants no.} 2 to 5 stood as a Guarantor in the loan facilities^{availed by the} Defendant no.1 and executed Guarantee Agreement^dated 08.10.2014 in favor of the Applicant Bank. The^defendants renewed the above mentioned loan facilities from time to^time and executed necessary loan documents in^{favor of the Applicant} Bank. After availing the loan facility, the defendants^{failed to} comply the terms of sanction, hence the applicant^{bank classified} the loan account as NPA and the Applicant Bank issued^Legal Notice dated 25.04.2026 to the defendants. lnspite of^several requests and demands, the defendants did not clear^the outstanding. Hence this OA.

Defendants called absent and set exparte on 13.08.2026.

Sri. J. Rama Rao, Chief Manager of the Applicant Bank examined himself as AW.1 and exhibited relevant documents, which are marked as Ex.A.1 to A.68.

Defendants remained exparte. To substantiate the case of the Applicant Bank, AW.1 , official of the Applicant Bank was examined and he exhibited relevant documents as Ex.A.1 to 4.68. ln view of the above, I hold that the Applicant Bank has established their claim made in the OA against the Defendants and hence the Applicant Bank is entitled to recover the claim made in the OA with future interest and costs.

ln the result, the present OA is allowed with costs, as under :

The Defendants No. 1 to 5 are^jointly and severally liable to pay to the Applicant Bank a total sum of Rs.2,13,83,210.00 Ps. (Rupees Two Crores Thirteen Lakhs Eighty Three Thousand Two Hundred Ten Only) with future rate of interest @16.00%^{p.a from 22.04.2026 tillthe date of realization.}

The Applicant Bank is entitled to proceed against the Hypothecated Movables and Mortgaged properties as mentioned in the Schedule of Property I to lll to the OA towards realization of the debt due.
