ORDER
in the application, the ApplicantBank t no. 1 is a Partnership Firmrepresentedby No. 2 and 3 availed Cash creditloan - with interest and executed Agreement

of Loan cum Hypothecation dated 17.08.2021 in favor of the Applicant Bank. The Defendants no. 2 and 3 stood as a Guarantor in the loan facilities availed by the Defendant no. 1 and executed Guarantee Agreement dated 17.08.202'l in favor of the Applicant Bank. The Defendants renewed the above mentioned loan facilities from time to time and executed Supplemental Agreement of Loan cum Hypothecation dated 13.09.2024 in favor of the Applicant Bank. After availing the loan facility, the defendants failed to comply the terms of sanction, hence the applicant bank classified the loan account as NPA on 31.03.2025 and the Applicant Bank issued Demand Notice dated 07.07.2025 under section 13(2) of the SARFAESI Act, 2002 to the defendants. lnspite of several requests and demands, the defendants did not clear the outstanding. Hence this OA.
