(1) O.A. 556 ol 2024 ll'led by the Appllcant Bank ls allowed and debt ls determln€d wlth cost agalnst the defendants. It ls hereby order€d that Appllcant Bank ls entlded to recover from the defendants the total amount to the tune of Rs.3,90,66,931.85/-^(Rupees Three Crores Nlnety Lakhs Slxty-Slx Thousand Nlne Hundred Thlrty-One lnd Elghty-Flve^palse only)^wlth pendente llte and tuture lnterest @ 12.75% per annum lnterest wlth slmple on the amount due from the date of flllng of the Orlglnll Appllcntlon l.e 10.09.2024 tlll^{full andfinal} realizatlon of the clalm amount.

(2) Amount, lf any, pald by the defendants ln th€ loan accounts or amount, lf.ny, recovered by the Appllcant Bank after flllng of the O.A. the same be taken^lnto account^{whlle arrlvlngat} the exact amount of duevdebt^payable by the defendants, Accordlngly,^{pendentellte and} future lnterest shall be calculated on the reduced amount.

(3) Defendants are debar.ed from dlsposlng, allenatlng or deallng wlth any of the^propertles belonglng to them tlll th€ aforesald decretal debt ls recovered from the defendants.

(4) Defendants are glven a tlme of thlrty days from the date of the JudgmenvFlnal Order for repaylng of the above mentloned dues, so lntlmated to them. In clse the defendants^{fall to} pay the dues wlthln the above mentloned tlme, the appllcant bank ls entltled to recover lts dues by sale of seclred assets, lf any. Appllcant bank ls also entltl€d to^pmceed agalnst

personal propertles of the defendants (Both movable and lmmovable) and also proceed .galnst the defendrnts personally to r€cover the dues ln accordance wlth law.

(5) Let the Ctrtlllcate of Recovery be drawn up by Ld. Reglstar forthwlth ln terms of Judgment for lssulnce of the same agalnst defendants ln favour of the appllcant bank under Sectlon 19 (22) ofthe Recovery of Debts and Bankruptcy Act, 1993 and put up the same for lssu.nce of the Certlllcate.

(5) Ld. Recovery Offlcer shall reallze the amount as per the Recovery Certlllcate from the defendants ln lccordance wlth law.

(7) Ld. Reglst6r of thls Trlbunal ls dlrected to dellver recovery certlf,cate ln term of the flnal orderludgment for recovery of th€ sum agalnst th€ defendants ln favour of the Appllcant Bank under Section 19(22) of the Recovery of Debts due to the Bank and Flnanclal Instltutlons Act, 1993 now known as Recovery of Debts and Bankruptcy Act, 1993.
