The Appllcant Bank flled the present O.A. betng No. O.A. 285 of 2025 on O9lO4l2O25 fot recovery of a total sum of Rs.23,21,086.03/- (Rupees Twenty Three Lakhs Twenty One Thousand Elghty Slx and Three patse onty) from the Defendants towards Houstng Loan together wlth lnterest, cost and other usual rellefs.

The Defendants are served wlth summons. The defendants dld not app€ar, as ther€ was no representatlon from the defendants, the case was flxed for ex-pafte hearlng on O4ILL|2O2S, and heard ex-parte accordlngly.

As stated supra, the Defendants remalned absent and dld not turn up to controvert the verslon of the O.A. of Appltcant Bank, The Evtdence Amdavtt coupled wtth the recttals tn the documents vlz., Exhlblts Annexure-A to Exhlblt Annexu.e-F marked on behalf of the Appllcant Bank, establtshed the datm of the Appltcant Bank agatnst the Defendants and OA schedule prope.tles. Hence, I hold that the Defendants are Jointly and severally liabte to pay to the Applicant Bank the claims made tn the OA wtth future tnterest and costs.

(1) O.A' 286 0f 2025 frted by the Applcant Bank is a owed and debt is determrned wrth cost agalnst the defendants, tt ls hereby ordered that Appltcant Bank ls enufled to recover from the defendants the totat amount to the tune of Rs.23,21,086.03/- (Rupees Twenty Three Lakhs Twenty One Thousrnd Elghty Stx and Three palse only) wlth pendente llte and tuture lnterest @ 09q6 per annum lnterest wtth stmple on the amount due from the date of flllng ofthe ortgtnat Appltcation t.e 09.04.2025 flll tull andfinal .eallzaflon ofthe clatm amount.

(2) Amount, if any, pard by the defendants rn the roan accounts or amount, rf any, recovered by the App'cant Bank after f*ng of the o.A, the same be taken rnto account whre arrrvrng at the exact amount of dues/debt payable by the defendants. Acco.dtngty, pendente ltte and future lnterest shall be calculated on the reduced amount.

(3) Detendants are debarred from dlspostng, allena ng or dealtng wtth any of the p.operfles belongtng to them ull the aforesatd decretal debt ts.ecove.ed f.om the defendants.

(4) Defendants are gtven a Ume of thtrty days from the date of the JudgmenvFhal Olde. for repayrng 0f the above menuoned dues, so rn mated to them. In case the defendants fail to pay the dues wtthln the above mentioned ttme, the applicant bank ts en.*ed to recove. its dues by sale of secured assets, lf any. Appllcant bank ls also enufled to proceed agalnst p€rsonal prcper es of the defendants (Both movable and lmmovabte) and also proceed agarnst the defendants personafly to recover the dues rn accordance vvrth raw.

(5) Let the Ce.tiffcate of Recovery be drawn up by Ld. Regtstrar forthwlth tn terms of Judgment

for lssuance of the same agalnst defendants ln favour of the apgllcant bank under Secflon 19 (22) of the Recov€ry of Debts and Bankruptcy Act, 1993 and put up the same for lssuance of the Ce.tiflcate.
