Heard the learned counsels for the parties.
Learned counsel for the appellant submits that he has already deposited Rs. 7.00 lacs before this Tribunal and today also he is depositing a demand draft No. 117077 dated 04.06.2025 for Rs. 1.00 lac towards pre-deposit. Let the amount deposited by the appellant be kept in the form of FDR in the nationalized Bank for a period of one year in auto renewal scheme.
Learned counsel for the appellant contends that the matter is listed before the Tribunal below on 14.07.2025 for final argument, therefore, the Tribunal below may be directed to decide the matter on the same day as the auction purchaser has also filed a writ petition before the Hon’ble High Court, which is listed for 16.07.2025. The learned counsel also submits that the respondent-Bank as well as the Tehsildar are going to take physical possession of the residential house in question. It is, therefore, prayed that the interest of the appellant may be protected till disposal of the S.A. pending before the Tribunal below.
Learned counsel for the respondent-Bank submits that as per order dated 22.05.2025, the bank has to take physical possession of the property in question and file affidavit with regard to compliance of the said order before the Hon’ble High Court by the next date fixed i.e. 16.07.2025, it is therefore prayed that no interim relief may be granted to the appellant.
