The Appellant is in appeal impugning the order dated 04.10.2023 in Appeal at Diary No. 1193/2022 allowing the appeal and setting aside the impugned order of the Recovery Officer, Aurangabad in Recovery Proceeding No. 75/2004. The Appellant is Respondent No.2 in the aforesaid appeal and is aggrieved by the order. Hence, he has filed this appeal.
There is a 25-day delay in filing the appeal. The reason for the delay has been explained. The Respondents have no objection and hence, this application is allowed and the delay of the 25 days in filing the appeal stand condoned.
The appeal shall be taken on file if there are no defects to be cured.
