Learned counsel for the appellant contends that ancestral property was inherited by four brothers, but heirs of one of the brothers, basing upon a gift deed mortgaged the property, which could not have been done as the share of the appellants could not have been mortgaged by the other co-owners without his consent.
Learned counsel for the respondent-bank seeks time to prepare the matter.
