Learned counsel for the respondent no. 2 submits that the S.A. has finally been decided and no cause of action survives, therefore, the present appeal has become infructuous and the same may be dismissed as such.
Accordingly, the appeal is dismissed as having become infructuous. The appellant is at liberty to challenge the final order by filing a fresh appeal, if so advised.
