Vide order dated 15.02.2023, this court has directed the appellant to make pre-deposit in the present case, but in the meantime, the urgency application was moved regarding substitution application being I.A. No. 130/2023 and the matter was preponed from 08.05.2023 to 29.03.2023.
Today, the office report dated 28.03.2023 shows that no predeposit has been made. Let the same be deposited by the next date, failing which the appeal shall be considered as not entertainable and accordingly the same shall stand disposed off for want of mandatory pre-deposit without further reference to this court. If the said amount is deposited by the appellant within the stipulated period, the substitution application is allowed and the necessary amendment in the array of parties of memo be made.
