Learned counsel for the appellant contends that the appellant was a guarantor to the loan extended to M/s Sunshine Infraheights Private Ltd., which amount has been settled by M/s Sunshine Infraheights Private Ltd. and no dues certificate dated 21.02.2023 has been issued by the Canara Bank to M/s Sunshine Infraheights Private Ltd., copy of which has been produced before this court, which is taken on record. It is contended that since entire loan amount has been paid and nothing remains to be decided, the appellant wants to withdraw the present appeal.
Learned counsel for the respondent-bank has no objection to the submission made by the learned counsel for the appellant.
In view of the above, the appeal is dismissed as withdrawn with no order as to costs.
