Heard the learned counsel for the appellant on the withdrawal application.
It is contended that the appellant has decided to settle down the matter with the Bank outside the court, therefore, he wants to withdraw the present appeal so that the matter will be solved without any litigation and delay. It is also contended that the appellant has deposited a sum of Rs. 24,21,465/- towards pre-deposit and the property is in possession of the Bank. Let the notices be issued to the respondents by two modes i.e. Registered Post with A.D. and Speed Post to response the same by the next, so that the matter may be settled amicably. Steps to be taken by the appellant within a week. Affidavit of service along with tracking report be filed by the next date.
