The office report dated 27.03.2023 shows that no steps have been taken by the counsel for the appellant for service of notice upon the respondent nos. 2 & 3 inspite of several opportunities being granted. As last opportunity, let the appellant take steps within a week for service of notice upon the respondents no. 2 & 3 as per earlier order dated 16.09.2022, failing which appropriate order shall be passed. Affidavit of service along with proof of publication be filed by the next date.
The aforesaid report further records that the reply to the waiver application as well as memo of appeal has been filed by the respondent no. 1, to which appellant may file rejoinder by the next date.
