THE APPELLATE TRIBUNAL :
Mr. Ganguly, Learned Counsel for Respondents prays for adjournment on the ground that Mr. Jishnu Saha, Learned Senior Advocate, who is appearing on behalf of the Respondents is not available in town.
Mr. Chowdhury, Learned Counsel for the Appellant strongly opposes the prayer and states that similar request was made on the last date of hearing wherein a specific order was passed that no further adjournment shall be prayed for by the parties.
Learned Counsel for the Appellant further submits that this is a matter of high magnitude of Rs.120 crore, which requires urgent hearing.
I have gone through the record and I find that on the last date of hearing on 23rd November, 2022 a similar request was made and it was allowed on the expectation

that no further adjournment shall be prayed for on the next date of listing.
Keeping in view the facts and circumstances of the matter let this matter be listed for hearing on 1st February, 2023.
It is made clear that if any adjournment is sought for, on any ground whatsoever it may be, the same shall not be entertained and the matter shall be heard on merits.
Rejoinder filed by the Appellant is taken on record.
