The office report dated 04.01.2023 shows that the respondent no. 1 has filed reply to the waiver application, but no reply has been filed on behalf of other respondents. The said report further reveals that the delay condonation application is pending and proof of publication regarding service of notice upon the respondent nos. 2, 3, 4, 5 & 7 has been filed, but none is present on their behalf.
The appeal is of year 2016. Let the served respondents put in appearance and file reply by the next date, if so desired, failing which no further opportunity will be given. The other respondents may file reply and appellant may file rejoinder to the reply of the respondent no. 1 by the next date.
Learned counsel for the appellant submits that the arguing counsel Shri Rakesh Mishra is indisposed today, therefore, he is unable to appear before this Tribunal, hence, he seeks adjournment.
