Learned counsel for the appellant submits that the arguing counsel Shri B. K. Kesharwani is out of station, therefore, he prays for adjournment. Learned counsel further states that in the meantime, he will file affidavit of service.
The office report dated 18.04.2023 shows that no steps have been taken by the appellant for service of notice upon the respondents pursuant to the earlier order of this Tribunal dated 29.03.2022. The earlier order dated 20.01.2023 of this Tribunal also shows that on that date, none was present on behalf of the appellant. Today also, the learned counsel Shri B. K. Kesharwani is not present as the appeal is of the year 2018. As such it appears that the appellant is not interested in pursuing the present appeal, therefore, the same is dismissed for non-prosecution.
