Learned counsel for the appellant contends that the ICICI Bank is only a proforma respondent in the present case, as there is no contest with regard to the sale conducted by the ICICI Bank, therefore, the service of notice upon the ICICI Bank may be dispensed with. The contesting respondent is only the respondent no. 1 only, as the relief sought is against the said respondent.
