Present: Shri V. K. Pandey, counsel for the appellant, Shri Himanshu Mishra, counsel for the respondent-Bank,
Learned counsel for the appellants submits that he will be depositing a demand draft of Rs. 9.25 lacs.
Learned counsel for the respondent-Bank submits that 25% of the amount due is approximately Rs. 15.00 lacs and the amount of Rs. 9.25 lacs is being shown to be deposited after taking several opportunities.
Learned counsel for the appellants prays for and is granted a month’s time to deposit remaining balance amount of 25% of the amount due for making the appeal entertainable and for consideration of waiver.
If said amount is deposited prior to the next date fixed, list this case on 16.08.2023. In case, the said amount is not deposited within the time as stipulated, the present appeal would be treated to have been dismissed for want of predeposit, which is mandatory in nature, without further reference to this court.
