It is contended by the learned counsel for the respondentBank that vide order dated 09.11.2021, learned counsel for the appellant was granted last opportunity to take steps for service upon the respondent no. 2, but the office report dated 14.11.2022 shows that no steps have been taken till date by the learned counsel for the appellant for effecting service of notice upon the respondent no. 2. Today also none is present on behalf of the appellant. Therefore, the appeal is dismissed for non-prosecution.
