Heard the learned counsels for the parties.
The present appeal has been filed under section 18 of the SARFAESI Act against the order dated 16.11.2021 passed by the DRT, Lucknow in T.S.A. No. 02/2021.
Learned counsel for the appellant submits that during the pendency of the present appeal, the respondent no. 7 has issued notice dated 07.10.2022 for taking the physical possession of the residential property (secured asset) on 21.10.2022. It is contended in the said appeal that the appellant has filed the present appeal for quashing the notice dated 07.10.2022 and auction sale notice dated 02.10.2022, but in the meantime, the effect and operation of the notice dated 07.10.2022 and auction sale notice dated 02.10.2022 scheduling the auction to be held on 20.10.2022 may be stayed till the disposal of the instant appeal.
Since the matter has been taken up, therefore, the urgency application being I.A. No. 480/2022 is disposed off.
