With regard to the defect no. 2, learned counsel for the appellant submits that the appellant is neither borrower nor guarantor, she is a third party, therefore, she has not received the notice under section 13(2) of the SARFAESI Act.
Stay and waiver applications have been filed without affidavit.
So far as the defect no. 6 is concerned, the learned counsel undertakes that he will file the same before the Hon’ble Court, if required.
This appeal has been filed by the appellant under section 18 of the SARFAESI Act, 2002 against the order dated 03.12.2021 in S.A. No. 113 of 2021.
