Heard the learned counsel for the applicant on the urgency application being I.A. No. 394/2023, which has been filed on the ground that the representative of the Bank had called for the appellant and threatened to take physical possession of the property within a week commencing from 22.05.2023 and interim order granted in this regard has been vacated. The matter is fixed for 06.07.2023. The record shows that no predeposit has been made in the present case.
Let the appellant show as to how the appeal is maintainable in absence of pre-deposit on the next date.
In view of the above, the urgency application is allowed and the date already fixed for 06.07.2023 is preponed to 30.05.2023.
