Present: Shri S. K. Gupta, counsel for the appellants, Shri Satyajit Mukherji, counsel for the respondent-Bank,
Shri Pradeep Kumar Pandey, Advocate appears on behalf of the respondent no. 3-Auction Purchaser and states that entire sale amount has been deposited by the auction purchaser and seeks time to file his vakalatnama along with reply.
Learned counsel for the respondent-Bank submits that he has given an undertaking before this Tribunal for not disturbing the possession of the property in question, due to which no action is being taken by the Bank, as more than Rs. 35.00 crores are still dues to be recovered and the property has been sold only for Rs. 3.35 crores and the appellant is enjoying the possession of the property without depositing any amount, therefore, learned counsel for the respondentBank wants to withdraw the undertaking given earlier.
The prayer of the respondent-Bank regarding withdrawal of the undertaking given earlier will be considered on the next date.
List this case on 24.08.2022 for waiver. Till then the undertaking given by the respondent-Bank shall continue.
