THE APPELLATE TRIBUNAL :
Heard Learned Counsel for the parties and perused the record.
At the very outset, Learned Counsel for Respondent submits that he has already filed opposition; though the same is not available on record. Registry is directed to place the same on record.
Learned Counsel for the Appellant prays for, and is granted, time to file rejoinder before the next date of listing.
Learned Counsel for the Appellant submits that operation of the impugned order dated 5th October, 2021 be stayed keeping in view the nature of the order wherein the sale was set aside. Accordingly, all the consequential proceedings were also set aside by the Learned DRT.

Without entering into the merits of the matter, Learned Counsel for Respondent states that the Respondents are not taking any steps in view of the order of the Learned DRT dated 5th October, 2021 till disposal of the present appeal but prays for early hearing of the appeal.
In view of the statement of the Learned Counsel for Respondent, list the matter on 8th September, 2022 for hearing of the appeal.
