Learned counsel for the respondent-Auction Purchaser submits that the matter be heard, since a huge amount is involved in the case, as neither the auction purchaser is getting the possession of the property nor the auction money is being refunded to him.
Learned counsel for the borrower states that the core question involved in the matter is with regard to the map sanctioned by the Nagar Nigam, Bhopal and the direction dated 10.09.2021 of this Appellate Tribunal has not been complied with.
The record shows that the Commissioner, Nagar Nigam, Bhopal is not a party to the proceedings, but the learned counsel for the appellant states that as per the provision of CPC, the Commissioner can be summoned. In this regard, the learned counsel for the appellant undertakes to show the said relevant provisions on the next date.
