Learned counsel for the appellant contends that Shri A. P. Singh has put in appearance on behalf of the respondentBank, who is main contesting respondent and the remaining respondents, who are represented through counsel Shri B. K. Srivastava, are proforma respondents, against whom no relief has been sought, therefore, there is no need to serve the notice upon them.

Learned counsel for the respondent-Bank submits that the complete record has not been given to him, who has been subsequently engaged by the respondent-Bank in view of the sad demise of earlier counsel of the Bank, therefore, sometime may be given. Record shows that reply of the served respondents and rejoinder thereto has already been filed. Let the learned counsel for the respondent-Bank reconstruct his file by the next date, on which the matter shall be heard.
