Received an application under section 18 of the Securitization and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 presented by Ld. Advocate, Mr. Rahul Auddy.
Scrutiny of the application reveals the followings:
The application has been filed on behalf of Siddhi Vinayaka Industries against the order dt. 23.09.2019 in SA-98/2019 passed by the Hon’ble Presiding Officer, DRT -1, Hyderabad. Application fees of Rs.50,005/- vide T.R. no.115372 dt. 30.11.2021 has been paid along with the application.
The Vakalatnama has been filed by the Ld. Advocate, Mr. Rahul Auddy .
The case is under the jurisdiction of this Appellate Tribunal.
The Application is filed within the period of Limitation with reference to ( Vol-I, page no.10-11) an order dated 20-10-2021 passed by The Hon’ble Supreme Court of India in SLP to Appeal no.14115/2021 (arising out of impugned final judgement and order dt. 31-032021 in WP no.18227/2020 passed by The High Court for the State of Telengana at Hyderabad) and the same is enclosed in Vol-II, page no.304.
The appellant and respondent no.1 both were not parties in SA/98/2019 in DRT-1, Hyderabad and the appellant further declares that it is neither borrower nor guarantor to respondent no.1 Bank (vol-I, page no.7). Appellant and respondent both become parties in the matter filed before The Hon’ble High Court for the State of Telengana at Hyderabad and The Hon’ble Supreme Court of India.
