THE APPELLATE TRIBUNAL :
I.A. 60 of 2022 is filed by the appellant praying for condoning delay of nine days in filing the appeal on the ground that it took some time for getting the papers from erstwhile advocate. Learned counsel submits on that ground appeal could not be filed within time.
Learned counsel for the respondent opposes the prayer.
Having gone through the records I am of the view that ground taken in the I.A. is sufficient for condoning the delay. Hence, delay is condoned. I.A. is allowed and thus disposed of. Registry is directed to provide regular appeal number.
Learned counsel for Respondent no.3 and 4 is present. Objection be filed by respondents within four weeks with advance copy to the appellant who may file rejoinder thereafter.
List the matter on 10.02.2023 for hearing.
