M/s Raunak Collection & Ors. Vs. Bank of Baroda & Ors.
Present: Shri Kushal Kant, counsel for the appellants, It is contended that the urgency, stay, delay condonation and waiver applications have been filed along with the present appeal. It is further contended that another appeal being Sr. No. 215/2019 was filed by the appellant and Rs. 9.00 lacs was deposited towards pre-deposit, which is still lying with the registry of this Appellate Tribunal. The said appeal has already been disposed off by this Tribunal vide order dated 01.02.2019 and that amount was to be refunded to the appellant. Hence, the said amount of Rs. 9.00 lacs be treated as pre-deposit in the present appeal. As such no further amount is required to be deposited towards pre-deposit.
Let the notice be issued on the waiver, delay condonation and stay applications to the respondents by two modes i.e. Registered Post with A.D. and Speed Post. Steps to be taken by the appellant within a week. Affidavit of service along with tracking report be filed by the next date.
List this case on 03.08.2022 for service.
