Learned counsel files I.P. O of Rs. 250/- in respect of Urgency Application. Learned counsel also files dates and events and appended stamp of the firm on each page. Double page Numbering has also been corrected by the learned counsel for the appellant. Learned counsel states that separate affidavits have not been filed with urgency and waiver application. Learned counsel states that affidavit is filed with the appeal. Leaned counsel states that one copy of memo will be supplied on next date.

As regards mandatory deposit of 25%, learned counsel has already Rs/. 3.80 crore in this Tribunal and the same has been kept in the shape of FDR. The amount involved in the O.A. 770/2018 is Rs. 16,39,12,944/-. Learned counsel has stated that in the same O.A. he has filed appeal Dy. No. 202/2021 in this Tribunal against the interim order, and the appellant has deposited Rs. 31 lacs with the Bank in terms of order dated 14.07.2021 of Hon’ble DRAT Allahabad in the Appeal Dy. No. 202/2021 (copy of the order dated is at page No. 245/246 of this Appeal). Hence, the appellant has deposited total Rs. 3.8 crore + 31 lacs i.e. total Rs. 4.11 crore which is more than 25% of the debt. Learned counsel also states that he has also filed Waiver Application and will argue the matter before the Hon’ble Court.
