The report of the Registrar dated 02.09.2022 shows that the present appeal has been filed under section 18 of the SARFAESI Act against the interim order dated 21.07.2022 passed by the DRT, Patna in S.A. No. 113/2020 and waiver application being I.A. No. 315/2022 has also been filed. The said report further reveals that no pre-deposit has been made, but the appellants have averred that the total amount of Rs. 51.00 lacs has been deposited with the Bank and the Bank has also recovered a sum of Rs. 75.44 lacs from auction of the secured asset, which was held on 19.05.2022.
Issue notices to the respondents on the waiver application by two modes i.e. Registered Post with A.D. and Speed Post. Steps to be taken by the appellants within a week. Affidavit of service along with tracking report be filed by the next date.
