Heard the learned counsel for the appellant.
I.A. No. 73/2022 which is waiver application, stating that the property in question has been auctioned for Rs. 7,53,400/and the amount due as shown in the demand notice issued by the respondent-Bank against the appellant is Rs. 2,33,966/-.
In view of the above, more than the demanded amount has been realized by the respondent-bank, therefore, there is no need to deposit any pre-deposit. Accordingly, the waiver application is allowed.
Issue notices to the respondents by two modes i.e. Registered Post with A.D. and Speed Post. Steps to be taken by the appellant within a week. Affidavit of service along with tracking report be filed by the next date.
List this case on 25.01.2023 for service.
