This Application is filed seeking advance hearing of IA 317/2022 i.e. Waiver Application from 08.09.2022 to this date.
Affidavit filed for Proof of Service of Advance Petition is sworn on 12.08.2022, whereas Postal Registered Receipt is dated 08.08.2022. When this was brought to the notice to Counsel for Petitioner, he submitted notice was sent for earlier date, that is, to which date main Waiver Application stood posted, but the purpose of Proof of Service in Advance Petition is not to show service of main Waiver Application, it requires service for Advance Petition. Admittedly, no proof of service is there for this IA 317/2022. Further, Affidavit filed in support of Advance Petition is sworn on 16.08.2022 and Petition is also filed on that day. Therefore, this Petition is dismissed.
