None is present on behalf of the respondent-Bank, although the name of Shri Avinash Jaiswal, Advocate is recorded by this Tribunal in the previous order dated 18.10.2022.
The office report dated 19.12.2022 shows that no affidavit of service has been filed with regard to service of notice upon the respondent no. 2 and no reply has been filed by the respondent no. 1. Let the same be filed by the next date.
Learned counsel for the appellant submits that the appellant is a third party, who has no concern with the loan, and the undivided property, which has been auctioned by the bank, cannot be done.
Let the learned counsel for the appellant inform the learned counsel for the respondent-Bank about the order passed today in writing within 48 hours that the matter will be taken up on 03.01.2023, on which date if no one appears on behalf of the respondent-bank, the matter will proceed.
