Learned counsel for the appellant has filed an urgency application stating that without any notice to the appellant, the possession of the secured asset has been taken on 01.11.2022. The said application has been filed on behalf of M/s Divyansi Traders and the said property is stated to be mortgaged by the Smt. Poonam Gupta, who is arrayed as respondent no. 4 in the present appeal.
Shri Arif Ikbal, Advocate appears by filing his vakalatnama on behalf of the respondent-Bank and submits that the copy of urgency application may be ordered to be served upon him.
Learned counsel for the appellant has given copy of the same to the counsel for the Bank, who may file reply by the next date.
