On a mention being made by the learned counsel for the appellants, the present case has been taken up today.

Heard the learned counsels for the parties.

Learned counsel for the appellants submits that the present appeal was filed for interim relief with regard to the possession of the property in question. The learned counsel further submits that the possession of the property in question has already been taken by the Bank and handed over to the auction purchaser, therefore, the present appeal may be disposed off with direction to the Tribunal below to decide the S.A., which is pending consideration, within the time as stipulated by this Appellate Tribunal.

Learned counsel for the respondent-Bank has no objection to the submission made by the learned counsel for the appellant.

In view of the above, the present appeal stands disposed off with direction upon the Tribunal below to consider and decide the S.A. No.594/2022, which is stated to be pending, in accordance with law most expeditiously, preferably within three months from the date of production of certified copy of this order.

A copy of this order be supplied to the parties as well as to the DRT concerned and be also uploaded on e-DRT portal.
