Present: Shri Gautam Kumar, counsel for the applicant,
An urgency application being I.A. No. 88/2022 has been filed on behalf of the applicant for preponing the date fixed in the appeal, which was directed to be listed on 16.08.2022 vide order dated 19.04.2022, whereas on the said date, nobody had appeared on behalf of the appellants. Learned counsel for the appellant shows his regret for non appearing before this Tribunal on 19.04.2022 and submits that the property of the borrower had been auctioned in the year 2008 and the auction purchaser is adamant to take physical possession of the property in question forcefully, therefore, the present urgency application has been filed.
Perusal of the earlier orders of this Tribunal dated 27.07.2021 and 06.09.2021 also shows that time was taken repeatedly by the appellant.
In view of the above, there is no urgency in the matter, therefore, the urgency application is rejected.
List this case on the date already fixed i.e. 16.08.2022.
