The present appeal has been filed under section 18 of the SARFAESI Act against the final order dated 05.08.2022 passed by the DRT, Lucknow in S.A. No. 425/2022.

The report of the Registrar dated 15.11.2022 shows that I.A. No. 575/2022 being urgency application, I.A. No. 576/2022 being exemption application for exempting the appellant from filing the certified copy of the order impugned, I.A. No. 577/2022 being Stay application, I.A. No. 578/2022 being waiver application and I.A. No. 558/2022 being delay condonation application are pending consideration.

Since the matter has been taken-up today, therefore, the urgency application being I.A. No. 575/2022 has become infructuous and is disposed off as such.

The said report further reveals that the amount due against the appellant is Rs. 34,60,506.14 and Rs. 12,13,765.21 as on 05.10.2020 and no pre-deposit has been made.

Heard the learned counsel for the appellant.

Let the Dasti notice be given to the appellant for service upon the respondent no. 2 personally. Notice may also be issued to the respondents by two modes i.e. Registered Post with A.D. and Speed Post. Steps to be taken by the appellants within a week. Affidavit of service along with tracking report be filed by the next date.
