Learned counsel for the respondent no. 3 submits that the principal borrower has entered into the compromise, according to which all the appeals filed by the borrowers including the present appeal are liable to be dismissed as withdrawn.
Learned counsel for the appellant submits that the present appeal has been filed by a third party and the property of the appellant has no concern with the borrowers, hence he does not want to withdraw the present appeal and on this ground, the learned counsel for the respondent-bank is not filing the reply to the memo of appeal and is lingering the proceedings of the case.
Learned counsel for the respondent-Bank is granted last opportunity to file reply by the next date, failing which appropriate order shall be passed.
