Petitioners herein seek quashing of FIR No. 04/2025 dated 02.01.2025, registered at P.S. IGI Airport (Delhi), for commission of offence under Section 420 IPC along with all consequential proceedings arising therefrom, on the basis of compromise arrived at between the parties.

Briefly stated, as per the averments appearing in the FIR, petitioner No.1-Sapnesh Kumar had induced complainant Ms. Vinita Singh and, while assuring her that he would arrange a job for her, took a sum of Rs. 3,00,000/from her. Some such amount was transferred by complainant in the account of petitioner No.2-Shubham Shrivastav and, therefore, his name also appears in the FIR.

Such assurance, regarding procurement of job, was apprised by complainant to Mr. Prashant Kumar, Mr. Gautam Sagar and Mr. Hitesh and they also met petitioner No.1-Sapnesh Kumar and the abovesaid amount of Rs. 3,00,000/- paid by the complainant to the accused was having

contribution from the abovesaid three persons also.

Charge-sheet has yet not been filed.

At the time of consideration of bail, the complainant had appeared before the Court of learned ACJM, Patiala House Courts, New Delhi and made statement that she had entered into compromise with the accused whereby she had agreed to settle the entire matter, upon refund of Rs. 3,90,000/- to her. She also deposed before the abovesaid Court that she would have no objection to the quashing of the case and also would have no objection if the bail was granted to petitioner No.1-Sapnesh Kumar.

It was in the abovesaid backdrop that the bail was granted to Petitioner No.1-Sapnesh Kumar on 06.03.2025.

Earlier also, a similar petition was filed seeking quashing of the FIR which was registered as W.P.(CRL)1281/2025 but the abovesaid petition was permitted to be withdrawn with liberty to file afresh after settling the disputes with the other persons also. It is important to mention that when the abovesaid petition was filed earlier, the settlement was with complainant Ms. Vineeta Singh Only.

Along with the present petition, the affidavits have been field by all the aforesaid persons i.e. Ms. Vineeta Singh, Mr. Prashant Kumar, Mr. Gautam Sagar and Mr. Hitesh.

Ms. Vineeta Singh is present, physically, before the Court, while the other three have joined the proceedings through video-conferencing .

Ms. Vineeta Singh is also present in Court and she also reiterates the terms of the settlement and submits that since the entire amount (her contribution and contribution received from the other three victims) has been duly refunded, she would have no objection if the present FIR is quashed.

The other three persons also submit that they have no objection if the present FIR is quashed and, when asked, they also claimed that they had already received the refund of their respective contribution from Ms. Vineeta Singh.

The case is still at the stage of investigation as the chargesheet has yet not been filed.

The Investigating Officer (I.O.) is present and identifies all the respondents.

It is also worthwhile to mention here that the FIR is only with respect to offence under Section 420 IPC, which is compoundable in nature.

Accordingly, exercising inherent powers vested in this Court under Section 528 of the BNSS, it is deemed appropriate to quash the instant FIR. 16. Consequently, to secure the ends of justice, FIR No. 04/2025 dated 02.01.2025, registered at P.S. IGI Airport (Delhi), for commission of offence under Section 420 IPC, along with all consequential proceedings emanating therefrom, is hereby, quashed subject to petitioners depositing cost of Rs.10,000/- each with Delhi High Court Staff Welfare Fund [Account no. 15530110074442: IFSC UCBA0001553] within 10 days from today.
